LEGAL NOTICE: This Agreement is a legally binding contract between Delabz and the user. By accessing or using Decane Wallet, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and Privacy Policy.
1. Introduction
Decane Wallet is a non-custodial Web3 wallet application designed to facilitate secure storage, management, and interaction with digital assets and decentralized applications. By using Decane Wallet, you agree to the terms outlined in this Agreement and acknowledge that you are solely responsible for safeguarding your access credentials, including private keys and seed phrases. Delabz is a technology company focused on decentralized finance solutions. Decane Wallet is offered for lawful purposes only and is not intended for use in jurisdictions where its use is unlawful or restricted. It is your responsibility to ensure compliance with all applicable laws and regulations in your jurisdiction.
2. Scope of Agreement
This Agreement applies to all use ofDecane Wallet, including but not limited to: downloading, installing, or using the wallet application; accessing any website, portal, or digital interface operated by Delabz; interacting with decentralized applications (DApps) or third-party services through the wallet; and engaging in asset swaps, bridging, or similar blockchain-based transactions.
3. Core Services Provided
Digital Asset Management: Store, view, and manage cryptocurrencies, tokens, and other blockchain-based digital assets securely on your device. All private keys and wallet data are generated and stored locally on your device. Delabz does not have access to, and cannot recover, your private keys,passwords, or seed phrases.
DApp Connectivity: Connect seamlessly to decentralized applications (DApps), including decentralized exchanges, NFT marketplaces, and on-chain protocols. Your interaction with DApps is at your own discretion and subject to the terms ofthose third parties.
Swaps and Bridging:Execute asset swaps and bridge assets across blockchains through integrated third-party protocols. Swap rates and bridging outcomes are estimates and may change. Delabz does not guarantee the accuracy or availability ofthird-party pricing or outcomes.
Network Interaction: View blockchain data, track wallet addresses, monitor transactions, and broadcast signed transactions to supported networks.
Additional Features: Receive product updates, security enhancements, and new feature releases that improve the functionality ofDecane Wallet. Important: Decane Wallet is a non-custodial solution. All private keys, seed phrases, and wallet data remain under your sole control. You are responsible for maintaining the confidentiality of your wallet credentials and backing up your seed phrase. Loss of this information will result in permanent loss of access to your digital assets.
4. User Responsibilities
Compliance with Laws: You will use Decane Wallet solely for lawful purposes and in accordance with all applicable laws, rules, and regulations, including those relating to anti-money laundering (AML),counter-terrorist financing (CTF), sanctions, taxation, and digital asset regulations in yourjurisdiction.
Security of Wallet Credentials: You are solely responsible for securing your private keys, seed phrases,passwords, and devices. Delabz does not store or have access to these credentials and cannot recover them iflost. The loss or compromise of your credentials may result in the permanent loss ofyour digital assets.
Transaction Responsibility: All transactions initiated through Decane Wallet are final and irreversible once submitted to the blockchain. You are fully responsible for verifying all transaction details before approval. Delabz bears no liability for transactions sent in error or to unintended recipients.
Gas Fees and Network Costs:You understand and agree that blockchain transactions require network fees (“gas”) that are beyond the control of Delabz. You are responsible for any fees associated with the execution ofyour transactions.
Prohibited Uses:You may not use Decane Wallet to engage in unlawful activities, including money laundering or terrorist financing, fraudulent activities or scams, distribution ofmalware or malicious code,or interference with the security or functionality ofthe Services..
5. Third-Party Services and Content
Decane Wallet integrates with third-party protocols, services, and platforms (“Third-Party Services”) to provide functionalities such as asset swaps, bridging, and analytics. These services are governed by their own terms and privacy policies.
No Control Over Third Parties: Delabz does not own, operate, or control Third-Party Services. Your use ofsuch services is solely at your discretion and risk.
Separate Terms: Your interactions with Third-Party Services may be subject to additional terms,conditions, and privacy policies imposed by those providers.
No Endorsement: The inclusion of Third-Party Services within Decane Wallet does not imply endorsement or recommendation.
Risk Acknowledgment: You understand and accept that the use of Third-Party Services may involve risks, including smart contract vulnerabilities, regulatory exposure, and the potential loss of digital assets.Delabz disclaims all liability for any damages, losses, or claims arising from your reliance on, or use of, Third-Party Services or content.
6. Risk Disclosures and Assumption of Risk
By using Decane Wallet, you acknowledge and accept the inherent risks associated with digital assets and decentralized technologies, including but not limited to self-custody risks, smart contract risks, market volatility, regulatory changes, and technology risks such as software bugs, downtime, cyberattacks, and network failures. You acknowledge that you are solely responsible for evaluating and bearing these risks. Delabz is not liable for any losses or damages arising from your use ofDecane Wallet.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Delabz, its officers, directors, employees, affiliates,and service providers shall not be liable for any indirect, incidental, consequential, exemplary, or punitive damages, including loss of funds or digital assets, loss of data or security breaches, downtime or software bugs, inaccurate estimates or pricing information from third parties, or regulatory actions affecting your access to the Services. In no event shall Delabz’s total liability for any claims related to your use of Decane Wallet exceed the amount you paid (if any) to access or use the Services in the twelve (12) months preceding the claim. You agree to indemnify and hold harmless Delabz from and against any claims,damages, losses, liabilities, or expenses arising out of or related to your use ofDecane Wallet or violation ofthese Terms.
8. Dispute Resolution and Binding Arbitration
Good Faith Negotiation: In the event of any dispute, controversy, or claim arising out of or relating to this Agreement, the parties shall first attempt in good faith to resolve the matter through informal negotiations. Either party may initiate such negotiations by providing written notice to the other party.
Binding Arbitration: Ifthe dispute is not resolved within thirty (30) days of such notice, the dispute shall be submitted to binding arbitration in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (SIAC). The seat ofarbitration shall be Singapore. The proceedings shall be conducted in the English language before one arbitrator appointed in accordance with the SIAC Rules. The arbitrator’s decision shall be final and binding, and judgment upon the award may be entered in any court havingjurisdiction.
Waiver of Class Actions: You agree that any claims must be brought on an individual basis and not as part of a class, collective, or representative proceeding. The arbitrator shall have no authority to consolidate claims or preside over class or representative actions.
Exceptions: Notwithstanding the foregoing, Delabz may seek injunctive or equitable reliefin any court of competent jurisdiction to prevent actual or threatened misuse, infringement, or misappropriation of its intellectual property rights.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale ofGoods shall not apply to this Agreement.
10. Amendments
Delabz reserves the right, at its sole discretion, to amend or modify this Agreement at any time. Updates will be effective immediately upon posting within the application or on our website. Your continued use of Decane Wallet following any such changes constitutes your acceptance of the revised terms. If you do not agree with the updated terms, you must discontinue use ofthe Services.
11. Termination
Delabz reserves the right, without prior notice or liability, to suspend or terminate your access to the Services if you breach this Agreement, if your use violates applicable laws, or if required by law, court order, or regulatory authority. Upon termination, your right to use the Services will immediately cease.Provisions that by their nature should survive termination shall remain in effect, including intellectual property rights, disclaimers, limitation ofliability, and dispute resolution.
12. General Provisions
Entire Agreement: This Agreement constitutes the entire understanding between you and Delabz and supersedes all prior agreements, understandings, or representations.
Severability: Ifany provision ofthis Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver: No waiver by Delabz of any term or condition shall be deemed a further or continuing waiver of such term or any other term.
Assignment: You may not assign or transfer your rights or obligations under this Agreement without prior written consent. Delabz may assign this Agreement without restriction.
Notices: All notices under this Agreement shall be sent to decanewallet@gmail.com and shall be deemed effective when received.
13. Privacy Policy
Delabz,we respect your privacy and is committed to protecting your personal data. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use Decane Wallet. By accessing or using the Services, you agree to the practices described below. If you do not agree, please discontinue use ofthe Services immediately.
14. Information We Collect
Decane Wallet is a non-custodial wallet and does not collect or store private keys, seed phrases, or wallet contents. We may collect: Voluntary Information (email or contact details you provide), Device and Usage Information (IP address, device type, OS, crash logs), and Communication Data (support emails/chats).
15. How We Use Information
We process information to operate and improve the Services; communicate updates and support; ensure security and integrity; comply with legal obligations; develop new features; and prevent, detect, and investigate fraud or abuse. We will not use your personal data for purposes inconsistent with this Privacy Policy without your consent.
16. Sharing and Disclosure of Information
We do not sell or rent personal data. We may disclose information to service providers under confidentiality; to comply with laws or lawful requests; in connection with a merger, acquisition, or sale of assets; to protect rights and safety; and otherwise with your consent.
17. Data Retention
We retain information only as long as necessary for the purposes described in this Privacy Policy, to comply with legal obligations, resolve disputes, or enforce agreements. Where possible, we anonymize or aggregate data.
18. Security of Your Information
We implement industry-standard security measures to protect collected data from unauthorized access or disclosure. However, no method of transmission or storage is completely secure. You acknowledge that blockchain transactions are irreversible and that you are responsible for securing your wallet and devices.
19. International Data Transfers
Your information may be transferred to and processed in countries other than where it was collected, including jurisdictions with different data protection laws. By using the Services, you consent to such transfers.
20. Your Rights
Depending on your jurisdiction, you may have rights to access, correct, or delete your data; withdraw consent (where applicable); and lodge a complaint with a data protection authority. To exercise rights,contact decanewallet@gmail.com.
21. Changes to this Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in technology, law, or our business practices. Changes are effective upon posting. Your continued use constitutes acceptance of the updated policy.
